I am unable to concur with the conclusion of the majority, for the reason that in my opinion the trial court committed no error in his application of the provisions of Sections 13441-1 and 13441-2 to the case at bar. In the light of the entire record, the accused was not denied a fair trial, and the judgment should therefore be affirmed.
