¶1(concurring in the result).

¶2I concur in the result because I believe the defect in William T. Ezell’s appeal to the circuit court was not that the court lacked subject-matter jurisdiction to entertain Ezell’s appeal on the basis that he did not have a right to appeal but that Ezell *459failed to state a claim upon which relief could be granted.
