Most-quoted passages
The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 24 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.
““Generally then this court may m-iew, on appeal from the judgment, any intermediate order involving the merits- or necessarily affecting the judgment. Appealable orders, from which no appeal has been taken, and nonappealable orders stand on the same footing-in this regard. This court on such appeal may also revieiv the sufficiency of the evidence, rulings made, and proceedings had upon the trial, when properly raised in the trial court and preserved by exception, or by proper assignment in a motion for a new trial.””
