Most-quoted passages

The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 5 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.

  1. “A check is a draft drawn on a bank, payable on demand. It is a negotiable instrument and is transferred by in-dorsement of the payee to the bank for the purpose of collection and the transferee bank obtains such rights as the transferor had. The bank then becomes the agent of the depositor for the purpose of collection. The relationship between the depositor and the depositary bank on deposited checks is presumed to be that of principal and agent and not that of debtor-creditor.”
