Most-quoted passages

The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 16 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.

  1. ““The Court instructs the jury that the law does not undertake to apportion or balance the negligence of the parties to a lawsuit where both the plaintiff and defendant are at fault in order to determine which is most at fault. The plaintiff may not recover from the defendants if he was guilty of any degree of negligence which proximately caused or contributed to cause the collision. “Accordingly, even if you believe from a preponderance of the evidence that the defendants were negligent, and that their negligence proximately contributed to cause the collision, if you further believe from the evidence that the plaintiff was also negligent and that his negligence proximately contributed to cause the collision, then you must return your verdict for the defendants.””
