¶1Judgment modified by striking therefrom the words “ rendering a verdict for defendant ” in the recital, and the words “ on the merits ” and “ together with ” in the ordering part; and in the latter inserting the word “ with ” in place of the words “ together with;” and as so modified unanimously affirmed, without costs.
