¶2 delivered a partially dissenting opinion.
¶3 I am of the opinion that the case should be remanded to the court below for the rendition of a decree in accordance with the facts as they may then appear. For aught we know, something may have occurred since the rendition of the decree appealed from that would affect the appellant’s right to a decree against the appellee.
