¶1dissenting.

¶2I join in the dissent of Clinton, J., except for that portion which suggests that the instruction was not required to be given with respect to the charge of assault with intent to kill. As stated in the dissent, “one may use deadly force to protect oneself from a forcible sexual assault.” § 28-836 (4), R. R. S. 1943.
