2 Del. 196

Baldwin v. Baldwin

Superior Court of Delaware

Decided July 5, 1837

Superior Court of Delaware · decided 1837-07-05

On a petition for divorce, the court stayed proceedings in the husband’s suit for the wife’s fortune, until he appeared to her petition.

Decided 1837-07-05

The Court

¶1 made the order. The whole proceeding is in this court and under our control: it is not reasonable that this man should be permitted to prosecute his suit and get possession of his wife’s fortune, while he stands out and refuses to appear to her suit for divorce. He asks justice; and he must not refuse to do justice.

¶2 Proceedings stayed.
