Anonymous

Superior Court of North Carolina

Decided October 5, 1796

Superior Court of North Carolina · decided 1796-10-05

Decided 1796-10-05

¶1If you have assigned matters of fact only, you may enter your judgment of reversal; if you have assigned matters of law, we must look into them. We cannot reverse the judgment merely because you have assigned instances of false judgment, if the matters assigned do not appear to warrant a reversal.

¶2The assignment was read, and the principal matter was that no time or place was appointed within thirty days, by the justice, for defendant's appearance.

¶3That is necessary by the act of 1794, ch. 13, secs. 3 and 6.

¶4The judgment was reversed.
