¶1THE defendant moved to put off the trial on an affidavit, that an attorney of this Court, was a material witness. He had not been subpœned; but had promised the defendant to attend ; and had left town a few days ago.
¶2Under these circumstances, the Court did not think a subpœna necessary to entitle the defendant to put off the trial.
