P. 15</bold><bold>Subpoena Power — Jurisdiction — Grant of Authority — Reciprocal</bold><bold>Agreements — C.A.R. 21</bold> Defendant Diomedes Arellano-Avila sought a court order to take the deposition of his nephew, a witness who "may be unable to attend" trial, under Crim. P. 15. The witness resides in Mexico and is a Mexican citizen. The district court ordered the deposition to take place in Mexico. The Supreme Court holds that neither Crim. P. 15, nor any other provision of law, allowed the district court to order that a deposition be taken outside of the district court's presence and jurisdiction.<page_number>Page 1192</page_number>
