<bold>1. Venue — Generally — Practice and Procedure</bold> Unless an action requires the court to directly establish, quiet, attach, transfer or bestow title to real property, provision of statute stating that "[a]ctions concerning real estate shall be brought in the county in which the lands, or some part thereof, lie" does not apply. <cross_reference>12 V.S.A. § 402</cross_reference>(a). <bold>2. Venue — Generally — Practice and Procedure</bold> Since plaintiffs' request for specific performance was personal in nature — the relief sought would require defendant to fulfill his contractual obligations — their action was transitory despite its affect on real property; consequently, county other than that where the property is located was a proper venue for plaintiffs' action. <cross_reference>12 V.S.A. § 402</cross_reference>(a). <bold>3. Vendor and Purchaser — Contracts to Convey Real Property —</bold><bold>Particular Cases</bold> Where the trial court's findings supported the conclusion that a purchase and sale contract constituted plaintiffs' offer to purchase defendant's farm for the stated amount, which defendant accepted and signed, as a result, plaintiffs created a contract they were entitled to enforce against defendant; that the attorneys for the parties erroneously characterized the agreement in their subsequent correspondence did not alter this conclusion.<page_number>Page 79</page_number> <bold>4. Vendor and Purchaser — Contracts to Convey Real Property —</bold><bold>Consideration</bold> The existence of sufficient consideration for a contract is a question of law and is evaluated at the time the contract was formed. <bold>5. Vendor and Purchaser — Contracts to Convey Real Property —</bold><bold>Particular Cases</bold> Where the trial court findings demonstrated that plaintiffs promised to purchase defendant's farm for a certain amount and, in return defendant promised to sell the farm to plaintiffs for that price, this bargained for exchange of mutual promises was sufficient consideration to support the contract. <bold>6. Appeal and Error — Filing of Notice of Appeal — Timeliness</bold> Plaintiffs' excuse that an attorney's vacation and a related breakdown in internal office procedures resulted in a late filing was insufficient to warrant a finding of excusable neglect; thus, their cross-appeal claiming attorney's fees was untimely and therefore failed. V.R.A.P. 4.
