¶1concurring in part and dissenting in part.

¶2¶58 I concur in Issues 1 through 6 and Issue 8.1 dissent on Issue 7: whether the court erred at sentencing in considering Dunfee’s other past acts resulting in police contact, irrespective of whether the acts resulted in charges or convictions. I dissent for the same reasons set forth in my dissent in State v. Mason, 2003 MT 371, ¶¶ 41-48, 319 Mont. 117, ¶¶ 41-48, 82 P.3d 903, ¶¶ 41-48.
