¶1{¶ 17} I concur in judgment and opinion but conclude any language that can be construed as directly addressing the merits of the first assignment of error is purely dicta. Although the language in ¶ 8 correctly states the black letter law concerning a trial court's jurisdiction to modify its oral pronouncement, once we have decided the oral pronouncement is not a final appealable order, we cannot explicitly rule on the merits of the first assignment of error.
