¶1Order unanimously affirmed, with ten dollars costs and disbursements to the respondent; said costs to be offset against the costs and such allowances as may be made to the infant defendant in the partition action; and the matter remitted to the Special Term to determine what allowances shall be made to the infant defendant and his guardian in the partition action.
