¶2As indicated in my separate opinion in United States v Stewart, 20 USCMA 272, 43 CMR 112 (1971), I adhere to the Noyd decision, but I conclude that the trial judge’s ruling was supported by sufficient evidence. I, therefore, join in affirming the decision of the Court of Military Review.
