¶2 The prevailing order on the petition for a rehearing in this case appears to be bottomed upon a presumption against the defendant-appellant.

¶3*504 ' We are still of opinion, from the record before us, that the punishment inflicted was oppressive, thus bringing it within the prohibition of Article 1, Section 19 of the Constitution of 1895.
