Most-quoted passages
The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 6 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.
“The personal representative of the estate of a deceased acts .in a fiduciary capacity. His duty is to manage the. estate under his control to the advantage of those interested in it and to act on their behalf. In the discharge of this duty, the executor or administrator of a decedent’s estate is held to the highest degree of good faith and is required to exercise the ordinary care and reasonable diligence which prudent persons ordinarily exercise, under like circumstances, in their own personal affairs.”
