PRESIDING JUSTICE LUND,

¶1specially concurring:

¶2Our esteemed colleague, author of the opinion, was one of those instrumental in the drafting of the legislation adopting first and second degree murder. In the past, he has used his intellectual talents joining with others lecturing on the subject of sections 9 — 1 and 9 — 2 of the Code. While I am convinced the constitutional issue presented in the instant case can be decided based upon our court’s decision in People v. Buckner (1990), 203 Ill. App. 3d 525, 530-34, 561 N.E.2d 335, 339-41, I recognize the value of this opinion for purposes of meaningful discourse.
