Applies OR 426 § 426.005

Decided 2008-05-28

PER CURIAM

¶1In this mental commitment case, appellant contends that the evidence is insufficient to support the trial court’s finding that, because of a mental disorder, appellant is a danger to others. ORS 426.005(l)(d)(A). The state concedes that the evidence is legally insufficient. On de novo review, we agree that the evidence is insufficient to support involuntary commitment.
