¶1The foregoing opinion of BENNICK, C., is adopted as the opinion of the court. The judgment dismissing plaintiff's petition is affirmed; and the judgment dismissing defendant's cross-bill is reversed, and the cause remanded, with directions that a new judgment be entered awarding to defendant the relief prayed for in said cross-bill. Haid, P.J., and Becker and Nipper, JJ., concur.
