The complaint alleged that the premises were sold by. the plaintiff to the defendant Jeannette C. Jeffe for $58,500 and that $55,500 of said purchase price was paid and that the balance, amounting to $3,000, was not paid but that the plaintiff received from Jeannette C. Jeffe at the time of the closing of the transaction of purchase a promissory note of which Jeannette C. Jeffe and Max M. Hart were the makers under the firm name of J. C.
