¶1[35] The foregoing opinion of BENNICK, C., is adopted as the opinion of the court.
¶2[36] The judgment of the circuit court is, accordingly, reversed in so far as it allowed plaintiff a recovery upon his cause of action, and affirmed in so far as it denied defendant a recovery upon his counterclaim.
