“(a) prudent man increases his watchfulness as the possibility of danger mounts. So then the degree of care required of one whose breach of duty is very likely to result in serious harm is greater than where the effect of such breach is not nearly so great. * * * In short the standard of care is a part of the law of the case for the court to explain and apply.
