¶1Judgment and order reversed upon the law and the facts, and new trial granted, costs to appellant to abide the event. There were controverted issues of fact which should have been submitted to the jury, and the court committed reversible error in directing the verdict. Lazansky, P. J., Rich, Kapper, Carswell and Scudder, JJ., concur.
