SYLLABUS BY THE COURT 1. TRADE SECRETS — <italic>Unauthorized Use — Unfair Competition — Proof</italic> <italic>Required.</italic> In an action to enjoin unfair competition arising by reason of the unauthorized use of a trade secret, the plaintiff must establish (1) the existence of a trade secret used by plaintiff in its business or trade, (2) a confidential relationship between the parties, (3) disclosures made in confidence by plaintiff to defendant concerning the trade secret, and (4) an unauthorized use of those disclosures by the defendant. 2. SAME — <italic>Definition — Factors to Consider in Determining</italic> <italic>Existence of Trade Secret.</italic> An exact definition of a trade secret may not be possible, but factors to be considered in recognizing a trade secret are: (1) the extent to which the information is known outside the business, (2) the extent to which it is known to those inside the business, <italic>i.e.</italic>, by the employees, (3) the precautions taken by the holder of the trade secret to guard the secrecy of the information, (4) the savings effected and the value to the holder in having the information as against competitors, (5) the amount of effort or money expended in obtaining and developing the information, and (6) the amount of time and expense it would take for others to acquire and duplicate the information. 3. SAME — <italic>Definition — What Trade Secret May Include.</italic> A trade secret may consist of any formula, pattern, device or compilation of information which is used in one's business, and which gives him an opportunity to obtain an advantage over competitors who do not know or use it. 4. COURTS — <italic>Enforcement of Orders.</italic> A district court clearly has both a statutory and an inherent power in Kansas to enforce its orders. 5. EQUITY — <italic>Injunction — Enforcement of Order by Court.</italic> When a permanent injunction has been issued, the court issuing the same is empowered to enforce both the letter and the spirit, or purpose, of the injunction and should do so at the request of the party who obtained the injunction. 6. COURTS — <italic>Enforcement of Orders — Supplemental Relief.</italic> A trial court has the jurisdiction, the authority, and the power not only to enforce its orders but also to entertain a motion for supplemental relief and to issue appropriate additional orders to make effective the relief previously granted.
