23 N.Y.2d 565

People v. Moore

New York Court of Appeals

Decided January 23, 1969

New York Court of Appeals · decided 1969-01-23

Decided 1969-01-23

Chief Judge Fuld (dissenting).

¶1The victim testified that the alleged theft (of which the defendant was convicted) was committed while he was actually raping her and, accordingly, her testimony required corroboration. (See, e.g., People v. Young, 22 N Y 2d 785, 786; People v. Radunovic, 21 N Y 2d 186.) Since, concededly, no such corroborative evidence was adduced, the convictions for robbery and larceny should be reversed and a new trial ordered on the entire indictment.
