¶1concurring specially.

¶2Although I agree the case sub judice should be affirmed, I cannot say that plaintiffs’ arguments were entirely frivolous or interposed for the purpose of delay. Defendant’s motion for frivolous appeal sanctions, pursuant to Court of Appeals Rule 15 (b), should be denied.
