¶1Appellant was convicted of the offense of assault with intent to rape, and the jury assessed his punishment at twenty-five years in the penitentiary.
¶2There is found in the record an affidavit signed by the district attorney of Bowie County showing the death of the appellant.
¶3The appeal is therefore abated.
