HAWKINS, J.

¶1Appellant was convicted for murder, and his punishment assessed at confinement in the penitentiary for a term of five years. He has on this date filed his personal affidavit with the clerk of this court asking permission to withdraw the appeal.

¶2The affidavit being in proper form, appellant’s motion is granted, and the appeal is dismissed upon said affidavit.
