WORTHLESS CHECK ACT — <italic>Sufficient Evidence For Jury To Convict</italic><italic>Under</italic>. In the instant prosecution for obtaining services and money by means of a bad check, defendant by his own admission knowingly issued the particular worthless check upon which the prosecution was based. These admissions, together with other testimony to the effect that defendant's bank account had been overdrawn and closed and that notice of these transactions had been given to defendant prior to the date of issuance of the check in question, were sufficient evidence for the jury to find the defendant guilty even though he had also told an officer that he intended to make the check good. The statute provides that giving of a worthless check shall be prima facie evidence of intent to defraud unless funds are deposited with the drawee bank within ten days. This was not done. The rebuttable presumption raised by dishonor of the check cast upon the accused the obligation of showing, if he could, that he had no actual intent to defraud.
