¶1(concurring specially)' — We concur in the foregoing opinion, except in so far as it may be construed as approving unnecessary delay, which we think this record clearly shows, in filing charges against the defendant after his arrest and incarceration. We agree under the circumstances here this was not ground for reversal, but we cannot approve the unlawful acts of the arresting authorities in violation of section 758.1.
