SYLLABUS BY THE COURT 1. NEGLIGENCE — <italic>Actionable Negligence — Existence Is Question of</italic> <italic>Law.</italic> Actionable negligence must be based on a breach of duty. Existence of duty is a question of law. Following <italic>Durflinger</italic> <italic>v. Artiles</italic>, <cross_reference>234 Kan. 484</cross_reference>, <cross_reference>488</cross_reference>, <cross_reference>673 P.2d 86</cross_reference> (1983). 2. SCHOOLS — <italic>School Buses — School District's Duties to Students</italic> <italic>Riding Buses Does Not Extend to Unloading Students on Side of</italic> <italic>Street Where Students' Homes Are Located or Requiring Students</italic> <italic>to Cross in Front of Bus to Cross Street.</italic> A school district which operates school buses has no duty to assign students to particular buses, to unload them only on the side of the street where their homes are located, or to require students to cross the street in front of the bus when unaware that the student needs to cross the street to go home.
