““The statute itself leaves the final determination at all stages of the proceedings to the trial court. Under the statute even if the final report from the Department of Mental Health concludes that a person is a criminal sexual psychopath, the court still finally determines this issue. Hence regardless of the testimony of the psychiatrists, it would not be binding on the trial court. “This court has previously held that the trial court has unrestricted discretion in the application of this statute and that the action of the trial court will not be reviewed. State ex rel. Savery etc. v. Marion Criminal Court, etc. (1955), 234 Ind. 632 , 130 N.E.2d 128 .” (Our emphasis.)”
