¶1Appellant was convicted of passing a forged instrument and sentenced to 2 years in the penitentiary by the District Court of Winkler County.
¶2An application has been filed by his attorney of record for the dismissal of the appeal on the ground that the appellant committed suicide on May 27, 1952. The application is granted and the appeal is dismissed. The original opinion is withdrawn and this is substituted in lieu thereof.
