Before O’Neall, J., at Darlington, Spring Term, 1840. This was an application for a quo warranto. After the respondent, elected since passage of the A. A., 1833, (p. 60,)1 had held for four years, an election took place, and the relator was duly returned. But the respondent refused to give up the office, alleging that his tenure was during good behavior.
