¶1In an action by plaintiffs, as assignees, to recover commissions alleged to have been earned by their assignor on a proposed sale by the defendants, judgment Was rendered in favor of the defendants, dismissing the complaint on the merits, following a trial by the court without a jury. The plaintiffs appeal. Judgment unanimously affirmed, with costs. No opinion. Present — Lazansky, P. J., Carswell, Adel, Taylor and Close, JJ.
