Order denying defendant’s motion to dismiss the plaintiff’s complaint pursuant to rule 107, subdivision 7, of the Rules of Civil Practice affirmed, with ten dollars costs and disbursements, with leave to defendant to answer within ten days from the entry of the order hereon.
