¶1On January 6,1887, defendant, appellant, mailed at Columbia, S. G., a notice addressed to Solicitor Orr, at Greenville, S. C., that he would move the court on the 10th inst. for an order restoring to the docket the appeal in this case, which had been dismissed by the clerk. This court, by its order of January 19, 1887, dismissed the motion without prejudice, “it not appearing that proper notice has been given to the respondent.”
