Habeas Corpus on appeal from the District Court of Live Oak. Tried below before the Hon. D. P. Marr. The relator in this case was held under an indictment which charged him with the murder of J. W. Wilson, in Live Oak county, Texas, on the thirtieth day of August, 1888. This appeal is prosecuted from the ruling of the trial court refusing bail, and remanding the relator to the custody of the sheriff of Live Oak county.

Willson, Judge.

¶1As presented in the record, the proof is not evident, in our opinion, that the applicant is guilty of a capital offense, and we therefore award him bail in the sum of eight thousand dollars. Upon his executing and delivering to the sheriff of Live Oak county a bail bond in said sum of eight thousand dollars, in the form and conditioned as the law requires, with sufficient sureties, said bond to be approved by said sheriff, the said sheriff will release the applicant from custody.
