Wiest, J.

¶1 (dissenting). I think plaintiff was a guest notwithstanding his gratuitous act in contributing 30 cents a day toward the expense of operating the automobile.

¶2 It being conceded that the owner of the car was guilty of negligence, I think plaintiff barred from having recovery under the rule of imputed negligence.

¶3 The judgment should be reversed, without a new trial.
