SYLLABUS BY THE COURT 1. CRIMINAL LAW — <italic>Sentencing — Multiple Conviction Case.</italic> K.S.A. <cross_reference>21-4720</cross_reference>(b) sets the procedure for determining sentences to be imposed in "multiple conviction cases." 2. SAME — <italic>Sentencing — Multiple Conviction Case.</italic> A multiple conviction case is a case involving sentencing on multiple convictions arising under a single charging document. The definition applies for all provisions of K.S.A. <cross_reference>21-4720</cross_reference>(b). 3. SAME — <italic>Sentencing — Multiple Conviction Case —</italic> <italic>Convictions Must Arise under Single Charging Document — Contrary</italic> <italic>Language in Another Case Disapproved.</italic> The language in <italic>State v.</italic> <italic>Christensen</italic>, <cross_reference>23 Kan. App. 2d 910</cross_reference>, <cross_reference>937 P.2d 1239</cross_reference> (1997), that conflicts with Syllabus ¶ 2 is disapproved. 4. SAME — <italic>Sentencing — Multiple Conviction Case —</italic> <italic>Statutory Application.</italic> K.S.A. <cross_reference>21-4720</cross_reference>(b)(5) is held to apply to nonbase sentences included in the same charging document as the base sentence. All sections of K.S.A. <cross_reference>21-4720</cross_reference>(b) must be construed together. 5. SAME — <italic>Sentencing — Crime Committed While Defendant</italic> <italic>Released on Bond — Statutory Application.</italic> A defendant who commits crimes while released on bond is not on conditional release under K.S.A. <cross_reference>21-4603d</cross_reference>. A district judge is not allowed to impose a prison term where presumptive nonimprisonment is provided for in the Kansas Sentencing Guidelines Act, K.S.A. <cross_reference>21-4701</cross_reference> <italic>et seq.</italic> absent a departure.
