SYLLABUS BY THE COURT 1. CRIMINAL LAW — <italic>Probation — Jurisdiction of Court to Issue</italic> <italic>Warrant for Violation</italic>. K.S.A. <cross_reference>22-3716</cross_reference>(a) establishes jurisdiction in the district court to <italic>sua sponte</italic> issue a warrant for a violation of a defendant's probation at any time before expiration of the probation term. 2. SAME — <italic>Probation — Revocation — Initiation of</italic> <italic>Proceedings by Court Services Officer — Jurisdiction of Court</italic>. The district court is not deprived of its jurisdiction to revoke probation when the revocation proceedings are initiated by a court services officer. 3. SAME — <italic>Probation — Initiation of Proceedings by Court</italic> <italic>Services Officer</italic>. K.S.A. <cross_reference>22-3716</cross_reference> does not limit the authority of a court services officer to initiate probation revocation proceedings by filing a motion and affidavit in the district court setting out the facts of an alleged violation. 4. SAME — <italic>Probation — Revocation — Calendar Year Used</italic> <italic>to Compute Timeliness of Revocation Proceedings</italic>. In determining the timeliness of a probation revocation proceeding, calendar years will be used and not the period of time established by K.A.R. <cross_reference>44-6-120</cross_reference> for calculation of good time credits. 5. SAME — <italic>Probation — Revocation — Delay in Initiation</italic> <italic>of Revocation Proceedings — Due Process</italic>. Delay between the time of a probation violation and the initiation of revocation proceedings does not constitute a due process violation unless prejudice to the defendant is shown by the delay, or there is an indication that the violation has been waived by the government.
