¶1concurring in part and dissenting in part.
¶2I dissent to the affirmance of the death sentence because the state’s closing argument in the sentencing phase was highly inflammatory, appealed to the passion, prejudices and generalized fears of the jurors, was not tailored to the defendant’s personal responsibility, relied upon the prosecutor’s personal opinions, and misstated the law.
¶3However, I concur in the affirmance of Johnson’s conviction, but in judgment only as to division 12.
