Allegrucci, J.

¶1concurring: I concur with the result reached by the majority but continue to disagree with the majority’s approval of the instruction given on premeditation. I do so based on the reasoning expressed in my concurring opinion in State v. Saleem, 267 Kan. 100, 977 P.2d 921 (1999).

Lockett, J., joins in the foregoing concurring opinion.
