THE COURT

¶1arrested the judgment on the ground that the information stated that the penalty accrued to the commonwealth. By the act of incorporation of Alexandria, all penalties for breaches of by-laws were to be for the use of the town, and to be levied by distress and sale of the offender’s goods.
