¶1On Rehearing

PER CURIAM.

¶2After further consideration of this matter on rehearing, the conclusion has been reached that justice would be served by modifying the judgment and sentence from 8 months in the penitentiary to a term of 4 months in the penitentiary.

¶3It is therefore ordered that the judgment and sentence be modified to 4 months imprisonment in the state penitentiary and as thus modified the sentence is affirmed. Mandate will issue immediately.
