¶1dissenting, said: I differ with my brethren on the two main questions involved in the ease: 1. I think Mitchell is not bound to account for the good will of the business, the partnership having been dissolved, and being in no sense a “ going concern.” 2. The real estate should be regarded in equity as partnership assets, and Mitchell’s title thereto sustained. I think, therefore, that the judgment of the court below should be affirmed.
