Fishburne v. Kunhardt

Court of Appeals of South Carolina

Decided January 15, 1844

Court of Appeals of South Carolina · decided 1844-01-15

jBe/bre-RicHARDSON, J. Charleston, October Term, 1843. This was an action of trover, to recover the value of four negroes.

Decided 1844-01-15

Wardlaw, J.

¶1I concur as to what is said of the Alabama Act. I think that possession by the mortgagor, after breach of condition, was a fraud as to any subsequent creditor without notice, which required explanation, and in this case I have not perceived any explanation which should have satisfied the jury.
